Quentin achieves Not Guilty result in ‘cut throat’ car crash case

Quentin was instructed by an insurance company to defend the insurer’s client Mr ZM, a bus driver. ZM was accused of forcing a car off the road resulting in the car mounting the pavement and hitting a number of pedestrians who were badly injured. In the background of the case was six-figure insurance claim.

The initial claim by the prosecution was that ZM was driving the bus in an irresponsible manner causing the driver of the other car to veer off the road and cause the accident. As such ZM was charged by the police and a prosecution was brought by the CPS.

Investigations were made around the circumstances of the alleged offence and CCTV was discovered from a local religious centre that overlooked the site of the accident. The CCTV painted a very different picture from the evidence that the prosecution sought to show, the CCTV suggested that the other car may have been to blame.

The CCTV was send to an expert witness where it was enhanced and was then sent to the CPS with an invitation to discontinue the case. The CPS agreed that the other driver was at fault and charged and prosecuted the other driver who was brought before the Court. Unbelievably the CPS also sought to maintain their allegations against ZM, alleging that both were at fault. A trial date was therefore set with both drivers charged.

At trial the defendants ran ‘cut throat’ defences- each blaming each other. Quentin robustly defended his client and conducted vigorous cross examination of the co-defendant highlighting her excess speed, poor driving and inconsistent accounts. The Court heard all the evidence and delivered a verdict of Not Guilty for Quentin’s client and a Guilty verdict in respect of the other driver. Costs were awarded in Quentin’s client’s favour.
