Mr RS undertook building development works in the Hillingdon area of London. As part of the development, he was responsible for the destruction and pollarding of a number of trees in an area where Tree Preservation Orders were in place.

Following complaints from neighbours to the development, an investigation was started by enforcement officers from the London Borough of Hillingdon.  Due to Tree Preservation Orders being in place, RS was contacted by enforcement officers who were investigating potential offences under Section 210 Town and Country Planning Act 1990 . He was invited to attend an interview under caution.

RS contacted Criminal Defence Barrister Quentin Hunt who specialises in representing clients accused of Tree Preservation Order offences. Quentin was instructed on a Direct Public Access basis

Quentin took immediate action to contact the Councill and seek pre-interview disclosure of the nature of the complaint about RS. Upon receipt of the disclosure Quentin set about putting together a detailed series of written representations to the Council citing legal deficiencies in their case as well as factual issues relating to the age of the trees backed by extensive arboriculture evidence.

Quentin’s representations were a success, and the Council decided to take No Further Action against Mr RS who was delighted that he avoided the stress and expense of litigation.
